InterExchange Au Pair USA Referral Program
Referral Program Policy
Effective Date: Ongoing until terminated or modified by InterExchange, Inc.
1. Purpose
The primary goal of this Referral Bonus Program (“Program”) is to expand InterExchange’s host family base by empowering InterExchange staff and certain current and former Program participants to share personalized referral links, encouraging new host families (“Referred Host Families”) to join our Au Pair USA Program.
2. Eligible Referrers
The following individuals and entities (“Referring Parties”) are eligible to participate in this referral program:
- Current or Former Host Families
- Current or Former Au Pairs
- Current InterExchange Local Coordinators
- Current InterExchange staff members
However, please refer to the Restrictions in Section 9 for limitations on specific Au Pair statuses (e.g., au pairs in transition or out-of-country pre-match situations).
3. Qualified Referral
A referral is considered Qualified if the Referred Host Family:
- Uses the personal referral link provided by the Referring Party to begin the application process;
- Meets host family eligibility criteria
- Completes the matching process with an au pair; and
- Welcomes the au pair into their home (i.e., the au pair has physically arrived).
Important: The Bonus shall apply to new Host Families welcoming their initial au pair only, and not to Host Families currently or previously in the Program (e.g., the Bonus does not apply to a reapplying Host Family or an existing Host Family). A referral will not be considered Qualified if the Host Family is already in the InterExchange database.
4. Referral Bonuses
Referring Party Bonus
- Reward: $250 gift card of the Referring Party’s choice (subject to availability).
- Conditions:
- The Bonus is issued after the au pair arrives at the Referred Host Family’s home.
- There is no limit to how many Qualified Referral Families a Referring Party may earn a Bonus for; however, there is only one (1) Bonus per Referred Host Family.
- If the Referring Party owes an outstanding balance to InterExchange for any reason, the Bonus amount will be applied to the Referring Party’s balance due. The Bonus is not redeemable as a gift card in such circumstances.
Referred Host Family Discount
- Reward: $250 discount on program fees (applied to the Referred Host Family’s account).
- Conditions:
- Referred Family must use the referral link during the application process.
- Discount applies after arrival of the au pair.
- Discounts cannot be redeemed for cash.
5. Payment & Payout Timing
- Payment Frequency: Referral bonuses are processed monthly for the newly arrived au pairs.
- Method of Distribution: The gift card reward for Referring Parties will be issued electronically or via mail, depending on preference, unless it is applied against a Referring Party’s outstanding balance.
6. Transferability & Substitution
- The Bonus is not transferable or assignable.
- The Bonus is not subject to substitution unless authorized by InterExchange in its sole discretion.
7. Tax Implications
- Referring Parties are responsible for reporting any referral bonuses they receive and handling any tax implications that may arise from these payments, according to local, state, and federal laws.
8. Tracking & Administration
- InterExchange will track and manage referrals through its referral platform.
- Referring Parties must ensure the Referred Host Family uses the unique referral link.
- In the event of any dispute or duplicate claim, InterExchange reserves the right to request additional information or documentation to verify the referral’s eligibility.
9. Restrictions
Au Pair in Rematching Restriction
- If the Referring Party is an Au Pair currently in Rematch (i.e., seeking a new Host Family while in the United States), they are not eligible to earn the Bonus for a family the Au Pair recruits to be their own new Host Family.
Out-of-Country Au Pair Restriction
- If the Referring Party is an Au Pair currently out of the country, they are not eligible to earn the Bonus for a family the Au Pair recruits to be their own Host Family through a “pre-match,” (i.e., found each other on a third-party site).
New Host Families Only
- The Bonus applies strictly to new Host Families only, and not to reapplying or currently participating Host Families.
One Bonus per Referred Host Family
- Only one (1) Bonus will be issued per Referred Host Family. If multiple Referring Parties claim the same referral, InterExchange will determine who, if anyone, is entitled to the Bonus in its sole discretion.
Outstanding Balance
- A Referring Party shall not receive any Bonus as a gift card if the Referring Party owes an outstanding balance to InterExchange. The Bonus will instead be applied to the Referring Party’s balance due.
10. Prohibited Conduct
In connection with participation in the referral program (“Program”), Referring Parties shall not:
- Conduct, or solicit the performance of, any illegal activity;
- Distribute referral links via bulk, automated, or spam email;
- Create multiple accounts using false personal information;
- Impersonate, or otherwise misrepresent another person’s identity;
- Stalk, harass, or harm another individual;
- Collect or store personal data about others without authorization;
- Interfere with or disrupt participation in the Program or Promotion;
- Attempt to gain unauthorized access to the Program or Promotion, or to other accounts, computer systems, or networks connected to the Program;
11. Liability
By submitting for the Promotion, the Referring Party agrees to hold InterExchange and its employees, directors, officers, licensees, licensors, shareholders, attorneys, contractors, and agents, including (without limitation) advertising and promotion entities and any person or entity associated with the Bonus or the production, operation, or administration of the Promotion, harmless and not liable for the Bonus or the Promotion. The Referring Party further agrees to indemnify InterExchange against all claims, demands, damages, losses, liabilities, costs, or expenses (including, without limitation, attorney’s fees) caused by, arising out of, in connection with, or related to the Bonus or the Promotion.
12. Dispute & Applicable Law
- Governing Law: This Policy, the Bonus, and the Promotion are governed by the laws of the State of New York.
- Disputes: In the event of any controversy or dispute regarding the Bonus or the Promotion, any determination by InterExchange will be final and conclusive for all purposes.
- Arbitration & Forum Selection: Any legal action arising out of or related to the Bonus, the Promotion, or these Terms and Conditions may only be brought through arbitration before the American Arbitration Association in New York City, New York.
- Class Action Waiver: Parties agree not to participate in a class action arising out of or concerning the Bonus, the Promotion, or the Terms and Conditions.
- If Arbitration is Unenforceable: The state and federal courts located in New York City, New York, shall have exclusive jurisdiction to hear any such claims, disputes, actions, or suits.
13. Policy Duration & Termination
- This Referral Bonus Policy is ongoing and remains in effect until terminated or modified by InterExchange.
- InterExchange may adjust the terms of this Policy at its sole discretion, including bonus amounts, discounts, and eligibility criteria. Notice of any changes will be provided to participants in advance.
14. Administrator of the Promotion
- The Promotion and Bonus are administered by InterExchange, Inc., which is located at 100 Wall Street, Suite 301, New York, NY 10005 (“Administrator”).
